These Terms & Conditions govern purchases made through MatoTanks.com and the use of services provided by Mato Tanks and Mato Toys International Inc.
By placing an order with Mato Tanks, you agree to these Terms & Conditions together with our applicable Shipping & Delivery Policy, Returns & Warranties Policy, Payment Policy, and Privacy Policy.
1. Orders
All orders are subject to acceptance by Mato Tanks.
We reserve the right to decline or cancel an order where reasonably necessary, including in cases involving payment problems, suspected fraud, pricing or listing errors, unavailable products, regulatory restrictions, or prior unresolved account or delivery issues.
If Mato cancels an order before fulfillment, any payment collected for merchandise not supplied will be handled in accordance with applicable law and our payment policies.
2. Made-to-Order Products
Many complete Mato Tanks are individually assembled, configured, and tested according to the customer’s selected specifications.
Customers should carefully review their selected model, electronics, options, accessories, shipping information, and customization requirements before submitting an order.
If changes or cancellation are requested after production or customization has begun, Mato will make reasonable efforts to accommodate the request, but changes or cancellation may not always be possible.
3. Prices and Payment
Prices, currencies, promotions, discounts, and payment methods available to a customer may vary by market.
Payment must be successfully authorized before an order can be processed.
Any obvious pricing, technical, or listing error may be corrected before fulfillment. If an error materially affects an order, Mato will contact the customer before proceeding where appropriate.
4. Shipping and Delivery
Customers are responsible for providing accurate shipping and contact information and for reasonably cooperating with carriers and customs authorities.
Production times, international delivery, customs clearance, duties, refused shipments, unclaimed shipments, and undeliverable shipments are governed by our Shipping & Delivery Policy.
5. Import Duties, Taxes and Customs
Unless Mato expressly states that specific duties, tariffs, or other charges are included, international customers are responsible for applicable import duties, taxes, customs requirements, brokerage charges, and other destination-country charges.
Customers are responsible for responding to reasonable requests from customs authorities and carriers required to complete delivery.
6. Returns, Refunds and Warranties
Returns, exchanges, refunds, and warranty claims are governed by our Returns & Warranties Policy.
Nothing in these Terms excludes or limits statutory rights that cannot legally be waived.
7. Failed, Refused or Unclaimed Deliveries
Customers must take reasonable steps necessary to receive their orders.
Where a shipment is returned, held, abandoned, or destroyed because the customer refuses delivery, fails to respond to the carrier, fails to complete customs requirements, fails to pay applicable charges, or otherwise prevents completion of delivery, Mato may recover or deduct reasonable resulting costs to the extent permitted by applicable law.

8. Payment Disputes and Chargebacks
If a customer believes there is a problem with an order, we encourage the customer to contact Mato Customer Care so that we can investigate and attempt to resolve the matter.
The use of PayPal, credit cards, or other third-party payment services may also be subject to the rules and dispute procedures of those providers.
Fraudulent, abusive, or knowingly inaccurate payment disputes may result in restrictions on future orders or non-warranty services, subject to applicable law.
9. Service Refusal
Mato may refuse future orders or non-warranty services where reasonably necessary, including in circumstances involving fraud, repeated payment abuse, unresolved amounts owed, deliberate refusal to accept shipments, failure to cooperate with delivery procedures, or abusive or threatening conduct.
Applicable warranty obligations and statutory rights remain unaffected.
10. Product Information
We make reasonable efforts to ensure that product photographs, specifications, descriptions, prices, and availability are accurate.
Because Mato products may be updated or individually configured, minor differences may occur between photographs and the final product where they do not materially change the ordered configuration.
11. Intellectual Property
The Mato name, logos, product images, website content, designs, text, and other intellectual property appearing on MatoTanks.com may not be reproduced, distributed, or commercially used without authorization except where permitted by law.
12. Limitation of These Terms
Nothing in these Terms is intended to exclude, restrict, or waive any consumer protection, warranty, or other statutory right that cannot lawfully be excluded.
13. Governing Law
To the extent permitted by applicable law, these Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
Mandatory consumer protections applicable in the customer’s jurisdiction remain unaffected.
14. Changes to These Terms
Mato may update these Terms periodically.
The version applicable to an order will generally be the version in effect when that order was placed, subject to any rights or obligations imposed by applicable law.
